Subject:-Regarding wrong definition of retirement leading to
distortion of pre-retirement discharging of duties.
Sir,
The administration and judiciary have been getting
exceptionally corrupt simply because the administrators and judges are getting profitable
posts after the retirement. They indulge in brazen corrupt practices for both
ruling and opposition parties alternately to hold some office of the profit and
remain in limelight even after the retirement solely endangering the security
and betterment of the mass. Recently the higher judiciary has been under
scanner in Bihar and across the country by granting bails unfairly and
indulging in corrupt practices viz the judge in Delhi for taking bribe, judges in
Bihar for indulging in sex romp and judges in Bihar granting bails to ISIS like
criminals in Bihar.
The post retirement appointment is constitutionally similar to
holding two posts of profit at one time which is a crime. The top statesmen in
our country have been punished in past for holding two posts of profit
simultaneously.
The post retirement appointees are generally more reckless
in functioning as they don’t have anything substantial to lose post retirement.
I have bitter experience with two heads of the commission, one was the head of
the Bihar Human Rights Commission who brazenly favored the wealthy and sourceful
accused against a genuine victim and the other is the head in Bihar State
Information Commission who brazenly criticized the government run institutions
and favored the showcasing institution ignoring its offences against the state
administration and judiciary to put pressure on the complainant to forgo the
complaint.
Our country with vision has introduced a system where
retired person can’t pursue law education as the age has been fixed for
pursuing law education, same pattern the retired bureaucrats and judges should
be banned from enjoying unfair profit.
I, therefore, appeal you to ensure the ban on appointment of
judges and bureaucrats post-retirement in institutions like Human Rights, State
Information Commissions and others or make the appointment thorough
multi-layered and apolitical selection procedure and save the mass from being brazenly
victimized in the hand of greedy and over-ambitious bureaucrats and judges.
