Fact or myth in consideration, Bihar Chief Minister Mr. Nitish Kumar has been undisputedly awarded the certificate to have been the person of development in a financially starving state of Bihar. If dropped the political vindictiveness, the man deserves higher berth than the berth in NITI AAYOG but his accommodation in NITI AAYOG would guaranteedly prove to be a boon at least for the recommendation of the policy for the financially starving states across India.

There has been a culture in our country that the member in opposition has been honored to be representative of the ruling faction. One such example is of former Prime Minister, Mr. Atal Bihari Vajpayee during the Congress dispensation.

I, therefore, appeal you to pause politically and consider Bihar Chief Minister Mr. Nitish Kumar accommodating in NITI AAYOG even exemplary.

Subject:-Regarding necessitating LIE-DETECTING, POLYGRAPHIC TEST and NARCO TEST on payment to prove innocence

Sirs,

As an existing social being and a social reformer, I am the eye and soul witness of many false court and police cases where the accused-victims keep crying foul, swearing by their loved ones and willing to pay anything to prove their innocence timely before the authorities from top to bottom but all in vain. The institution, the court of justice, where little is heard is always late and costs the prestige, money, career and life of the innocent.

The pseudo-complainant never accepts nor offers any scientific method to prove truthful to the manipulated accusations but the victims of pseudo-accusations are always ready to undergo any scientific test to prove their innocence risking the reputation, money, career and life which is ignored insensitively, tactically, racially, regionally, bureaucratically, socially or illegally.

The theme of our justice system is to free hundred criminals to save single innocent but it applies only on VVIP and not on cattle class de facto.

Our country doesn’t rule out the fact that the lives of innocent are destroyed through immatured, unfair and delayed justice.

I, therefore, appeal you to ensure necessitating the scientific test including LIE-DETECTING, POLYGRAPHIC or NARCO TEST at least on the request and demand of pseudo-accusations victims against the payment incurred on such test.

राजधानी पटना में आई पी एस के घर कब्ज़ा कर वेश्यालय चलाने का मामला !!

विषय:-अध्यादेश लाकर जमीन-मकान पर कब्ज़ा करने वालों के विरुद्ध त्वरित करवाई करने के सम्बन्ध में ।

महाशय,

निवेदनपूर्वक कहना है कि आपके आदेश जिसमें जमीनी विवाद को जल्द से जल्द प्राथमिकता देकर पुलिस-प्रशासनिक स्तर से निबटने का आदेश दिया जाता है लेकिन पुलिस बार बार यह फरमान जारी करती रहती है और थाना को हिदायत देते रहती है कि जमीनी विवाद में पुलिस तटस्थ (न्यूट्रल) भूमिका निभाए । इस टकराव का परिणाम है कि आपके मुख्यमंत्री आवास से महज तीन-चार किलोमीटर की दूरी पर एक वर्तमान आई० पी० एस० अधिकारी के मकान और जमीन पर अवैध रूप से कब्ज़ा कर पहले शराब का धंधा, अवैध रूप से एल्युमीनियम गलाने और वर्तमान में वेश्यालय चलाया जा रहा है और थाना आपके आदेश का नहीं बल्कि अपने वरीय अधिकारीयों के आदेश का पालन करते हुए तटस्थ भूमिका निभा रही है ।

ऐसा ही एक मामला आपके मुख्यमंत्री आवास से तीन किलोमीटर की दूरी पर का है जिसमें आपकी पार्टी के एक लम्बे समय से आपके साथ जुड़े वरीय अधिवक्ता के आने-जाने के रास्ता पर अवैध रूप से कब्ज़ा कर शौचालय का निर्माण कर लिया गया है जिसमें पुलिस आपके आदेश का नहीं बल्कि अपने वरिय पुलिस अधिकारीयों के आदेश का पालन करते हुए पच्चीस दिनों तक तटस्थ भूमिका निभाती रही उसके बाद बिना किसी समाधान के खानापूर्ति के लिए धारा 107 लगाई ।

उक्त दोनों सख्स आपके भरोसे बैठे हुए हैं कि उनके त्वरित निष्पादन के लिए आप कोई न कोई कानूनी उपाय निकल कर घंटों या दिनों में अवैध कब्ज़ा से उनके साथ अन्य पीड़ित को भी मुक्त करायेंगे । 

अतः आपसे निवेदन है कि मामले को गंभीरता से लेते हुए एक अध्यादेश लाकर उक्त दोनों मामले के साथ अन्य ऐसे मामले को जल्द से जल्द निबटाने का पहल करने की कृपा करें ।

Subject:-Regarding the extension of courts of Bihar to Delhi

Sir,

Most humbly I wish to say that despite the existing law and order situation in Bihar and Patna people feels the dire need to fight cases in court of law which is not less threatening as the hardcore, habitual & suicidal-criminals are out to stop any lawful action against them as usual. To stop lawful proceedings and actions, the suicidal-criminals spare no one with exception eliminating and influencing the lawyers, witnesses, investigation and even the courts proceedings. Some people are forced to leave the state which deprives and debars the refugee or migrants to lodge or pursue the cases in courts as the jurisdiction of courts are limited or confined to particular state.

I, therefore, appeal you to consider the extension of relevant courts outside Bihar to get the people justice equally across the nation regardless of the jurisdiction of crime and other possible remedies.

Subject:-Regarding invitation of suggestions to improve Collegiums System

Sir,

With little knowledge and experience about judiciary I courteously wish to say that the gap between corruption charges-prone police and judiciary has narrowed remarkably but actions against judges are dream come true yet after the creation of provisions to directly complain against judges. The complaints against judges and its logical ends are similar to complaints against oversea official and offenders who are regionally or nationally immuned against any meaningful actions.

The judiciary should be hawk-eyed to find offences resulting in punishments, rather having social & political practices in view as the medicos are concerned about disease and its treatment regardless of the caste, creed and belongings of the patients.

Recently ABP news channel telecast that there are practicing lawyers in hundred who is blood relatives of Allahabad High Court judges but who cares, no dismissal and cancellation of the licenses of accused has become the news. The message is clear that the real justice is below the judicial manipulation and management.

There is one case of three students encounter in Patna, the accused police and others were awarded death and life-imprisonment by lower court but Patna High Court honorably acquitted all of all the charges on 04 November 2015. The state judiciary appeared to be a share stock market which rose in decade with the hopes of the victims and crashed in cipher after sensing the unquestionable hopes of the victim in judiciary. This is very filmy and dramatic but who cares.

The collegiums System may need the following changes;-

1.     Effective and timely result-oriented complaint mechanism against judges.

2.     Transparent lottery system for the appointment and promotion of judges.

3.     Creation of a web portal under SC to upload disputing judgments of different courts by victim and accused as well.

4.     Caste and creed should be non-prioritized in promotion and appointment of judges.

5.     The time limit must be set for judgment in all the courts

6.     Above all, the existing rules for judiciary should be transparently and forcefully implemented.    

7.     Creation of a software to feed the data related to case to get computerized justice corresponding the existing justice system to avoid total control by human.

Subject:-Reiterating the ways to curb growing religious intolerance

Sirs,

Excessive privileges to one section in the society and biased implementation of laws of land for different sections in the society are the best source to create rift leading to the present religious intolerance.

Even in Hindu religion, there are different believers, practitioners and followers of deities but there is nothing hurting and clashing one another.

Muslims and Christians have more than one practitioner, believers and followers of deities who clash and massacre one another which prove they are unreasonably and religiously intolerant.

Their religion apparently teaches them to compete their religion themselves and the religions of others rather enhance their own religion.

Our constitution and executives are is too liberal to allow the so called minorities to choose the ways for religious evil practice. They are unfairly so much privileged that they override the social, ethical, religious and intellectual understanding enshrined in the constitution. The provisions in Muslim Personal Law and private laws of Christian rubbish the best constitution accommodating all the religions and beliefs. The private law boards of Muslim and Christian not only tinker with the fabric of the constitution, hurt the human-socio fabric but also damages the natural resources for the deserving by shooting up population and pollution leading to uninhabitable conditions.

Politician driven or compelled administration and judiciary partially fail to ensure the implementation of laws and subsequent and supplementary order of higher judiciary. One example is that the mosque beside temple is not asked to follow the SC orders whereas the temple is coercively asked to toe the SC order on loudspeaker. The so-called minorities are welcome by the administration to create noise in the government institution including police station but Hindus are kicked out by the administration from the same place which foster religious intolerance.

पुलिस की दुश्मन पुलिस !!

विषय:-पुलिस वालों को किराया पर मकान देने वाले मकान मालिकों के लिए त्वरित विवाद निवारण प्रणाली के गठन के सम्बन्ध में ।

महाशय,

निवेदनपूर्वक कहना है कि बिहार के विभिन्न जिलों में पुलिस विभाग अधिकतर पुलिस वालों को रहने के लिए कार्य स्थल के आस पास क्वार्टर की व्यवस्था करने में सक्षम नहीं है जिसके परिणामस्वरुप पुलिस वालों को किराया के मकानों में रहना पड़ता है । पटना में ऐसी समस्या ज्यादा देखने को मिलती है । लेकिन पटना में अधिकतर पुलिस वालों द्वारा मकान मालिकों के प्रति गढ़ी गयी नकारात्मक छवि के कारण अधिकतम मकान मालिक कुछ अच्छे पुलिस वालों को भी अपना मकान किराया पर देने से कतराते हैं । मकान मालिकों द्वारा पुलिस वालों के प्रति ऐसे रवैये से पुलिस वालों के सामने आवासीय स्थिरता का संकट पैदा हो गया है जिसके कारण पुलिस वाले अपने और अपने परिवार वालों के लिए आवास के प्रति चिंतित रहते हैं परिणामस्वरुप अपना कर्त्तव्य जिम्मेवारी पूर्वक निभाने में विफल या त्रुटिपूर्ण रहते हैं ।

अतः आपसे निवेदन है कि आप अपने स्तर पर एक ऐसी प्रणाली का गठन करने पर विचार और उसका प्रचार करें जिसमें मकान मालिकों और किरायेदारों (पुलिसवालों) के बीच लिखित व निर्धारित शर्तो के अनुपालन पर आपके स्तर से मकान मालिकों को बिना परेशानी के तुरंत राहत पहुँचाया जा सके ।
