Subject:-Regarding invitation of suggestions to improve Collegiums
System
Sir,
With little knowledge and experience about judiciary I
courteously wish to say that the gap between corruption charges-prone police
and judiciary has narrowed remarkably but actions against judges are dream come
true yet after the creation of provisions to directly complain against judges.
The complaints against judges and its logical ends are similar to complaints
against oversea official and offenders who are regionally or nationally immuned
against any meaningful actions.
The judiciary should be hawk-eyed to find offences resulting
in punishments, rather having social & political practices in view as the medicos
are concerned about disease and its treatment regardless of the caste, creed and
belongings of the patients.
Recently ABP news channel telecast that there are practicing
lawyers in hundred who is blood relatives of Allahabad High Court judges but
who cares, no dismissal and cancellation of the licenses of accused has become
the news. The message is clear that the real justice is below the judicial
manipulation and management.
There is one case of three students encounter in Patna, the
accused police and others were awarded death and life-imprisonment by lower
court but Patna High Court honorably acquitted all of all the charges on 04
November 2015. The state judiciary appeared to be a share stock market which
rose in decade with the hopes of the victims and crashed in cipher after
sensing the unquestionable hopes of the victim in judiciary. This is very filmy
and dramatic but who cares.
The collegiums System may need the following changes;-
1.
Effective
and timely result-oriented complaint mechanism against judges.
2.
Transparent
lottery system for the appointment and promotion of judges.
3.
Creation
of a web portal under SC to upload disputing judgments of different courts by
victim and accused as well.
4.
Caste
and creed should be non-prioritized in promotion and appointment of judges.
5.
The
time limit must be set for judgment in all the courts
6.
Above
all, the existing rules for judiciary should be transparently and forcefully
implemented.
7.
Creation
of a software to feed the data related to case to get computerized justice
corresponding the existing justice system to avoid total control by human.
